The Justice Department continues to pursue Eli Gold even though their wiretap evidence has been thrown out. Josh Perotti tells Eli's lawyer, Elsbeth Tascioni, that he will now be pursuing a conspiracy case against her client and has a witness who will testify against him. It turns out that witness is the head of the local Democratic party and his testimony relates to Eli arranging to pack a straw poll with seniors from an old folks home. As both lawyers spar back and forth deftly countering each others thrusts, the case begins to affect Peter's run for governor - and results in Peter's mother Jackie being called as a prosecution witness. Meanwhile, the firm tries to get a contract with the State's Attorney's office to deal with any civil suits brought against them.
